Fraud and Public Mischief Charges Dismissed

The client was charged with fraud over five thousand and public mischief.  The police alleged that the client had made a false claim that his property was stolen.  The prosecution elected to proceed by indictment.

The client maintained his innocence and instructed our office to proceed to directly to trial.

Our office prepared an extensive defence.  Relying on our significant experience a sound strategy for trial was developed.

In preparing for cross examination, our office conducted its own investigation and research uncovering that the prosecution’s case was based on a flawed belief in suspect technology.

After effective cross examination of the key Crown witnesses, we were able to expose the major weaknesses in the Crown’s case.  It became clear to the trial judge and the prosecutor that the case against our client was in trouble.  As a result after one day of trial, the prosecutor re-assessed the strength of their case and properly invited the trial judge to dismiss all the charges.

The client was vindicated.

This was an example of how strong preparation and cross examination can produce optimal results.
